police say that alcohol was my factor, she resigned from the alameda county board of supervisors after in bidding to personal problems including what she called an assault by an ex- boyfriend that she met in rehab. the district attorney in santa cruz county says paul will send a ball will not face charges. he had been accused of sexual assault but the district attorney said that there is no physical evidence or witnesses testimony to back a claim by woman who said that he assaulted her at a resort last month. the sheriffs department issued a similar statement last week citing a lack of evidence. >> like many people, when they start a search, a guy who went to google to find a new leader. former google executive melissa meyer was officially announced as the new ceo of your hope. her tenure begins tomorrow at the struggling sunnyvale company. yacht to host the 37 year-old can bring some stability to a company that has had five ceos in as many years.

room workers has been a flat tire on the wheels of justice in san fransisco. at the civil courts building i found frustrated people having to file paperwork into an unmarked boxes. at all justice, sign after sign saying that the court room was out of commission today. hallways are usually bustling but were completely empty. >> they are very totalitarian about their demands and have not been bargaining in good faith. >> union workers with s e i u say that they'reot upset about a 5 percent pay cut imposed on them earlier this month, they say that they're mostly angry that the state will not provide them with financial information, details that would explain why they have had to be on the receiving end of never-ending cuts every year since 2008. >> we have the right to have that information and it has come to a point now where we cannot safely negotiate or enter into a deal without knowing all of the budget numbers. >> i am not saying that justice is at a platinum level today,

but justice is continuing. >> the court ceo said that mannesmann was ready and stepped in this morning with a strike plan, replacing clerks' with managers. >> there have been no criminal trials that have been released because of the strike. it is business as usual. is it inconvenient? absolutely. >> the court ceo says that it turns out that nine out of the 12 criminal court stayed open and the other three had to shut down for the day. overall they say that they kept more than 60 percent of the courts opened. but it is not clear how much business ashley got done. clearly this one day strike made a major impact. >> thankyou. >> a conference of federal judges scheduled to be held in monterey next year has been cancelled for budget reasons. the cancellation of a court of appeals conference comes in the wake of criticism of this year's conference which will be held in hawaii in august, two republican

senators raised questions about federal judges holding their meeting in vacation spots. the accord includes judges in nine western states. >> family members accused of beating and mistreating mentally disabled adults and san jose went before a judge today and four of the suspects are now back in custody. len ramirez is outside of the courthouse with details on the conditions inside of the families upscale home. >> this is a very unusual case and for the family members involved, a very tragic case as well. we are talking about 12 adults and more than two dozen dogs, all living under the same roof allegedly in the same deplorable conditions. four of the people accused in this case walked into the hall of justice this morning but they did not walk out. >> house that of all justice, she hid her face from the cameras, she is one of five family members accused running an abusive and felt the home for

one dozen mentally ill adults out of this luxury house in the san jose foothills. but inside of a court room, she stood before a judge in answer to charges of abusing and neglecting it dependent adults. when she could not pay her bail set at $50,000, the judge ordered a deputy to put her in handcuffs and take her off to jail. >> i was very happy. i have been waiting for this moment for the past month. >> angela brought the case to life, she had two uncles that lived at the house. after one of them died in may she got suspicious when she was not allowed to visit her other uncle who said that he was kept a prisoner and abused over a 10 year time span. >> he said that if he did not agree with something with them that they would hit him. >> 4 05 family members are now in custody besides 15 counts of dependent abuse their charged

with animal abuse, the district attorney says that the family kept them mistreated 25 dogs who lived with a human patient in a share horrible conditions. >> they did not have running water in some of the house, no toilet paper that they could use. and, so there was a dog excrement, you're in throughout house. some of the victims were just wearing clothing that had been urinated on by the dogs. >> the family's lawyer says he cannot say much now because he just got the case. >> we're going to provide an adequate investigation to look into all the allegations that have been made and let the facts fall where they may. >> a fifth family member has not yet been charged but that is expected to happen soon. all the other four defendants in this case will be back in court to enter a plea on august 21st. the district attorney says he does not know how big his case may be and is asking any other family members who have had someone stand house over the

years to please give him a call. it ought to investigate this fully. >> stunning allegations. thank you. >> checking bay area headlines, sunnyvale police arrested two men in connection with a home invasion-robbery today. officers say that a spot of the suspects fleeing a house on foreign street earlier this morning. police caught one suspect right away and found a second to hiding later in my backyard nearby. the homeowner was not hurt. today, as riser agreed to pass on his offer company and other intellectual assets to his two children for killing their mother. the ron paul death suit as been placed in the jury's hands. lawyers for his son and daughter want him to pay $25 million for killing his wife in 2006. he is serving 15 years to life for that murder. at this hour activist in the san fransisco bayview district are holding a vigil to market one year since the shooting death

>> he is not the only homeowner taking advantage of record low interest rates. a cbs 5 consumer watch reporter tells us that homeowners that have recently refinanced are applying second, third, or fourth time, to get the best rate possible but that is expensive. >> it is not for everyone but there is certainly a refinance mania, even for those that got a great rate, now a buyer's remorse so they're continuing to refinance over and over as rates continue to drop but that is not stopping them from going back to the bank. >> she is not afraid to ask for lender for a lower interest rates. >> i could hardly believe it when my mortgage broker called and said i could save more money. >> she just refinanced your home for the fourth time in three years at an interest rate that a lot of people might envy. >> the latest interest rate is 3.75. >> something she could not even imagine when she bought her lost 20 years ago.

>> at that time i had a car loan at the same rate and now have a mortgage at that rate. >> many homeowners that purchased recently are also looking for a better deal, in california applications to refinance are up 90 percent since this time last year, driven largely by rising home values and record low rates. the average rate on a 30 year fixed mortgage has seen more than a three quarter point drop in the year, a difference that can mean hundreds of dollars per month in mortgage payments. >> this is for the people that are doing ok. >> this mortgage brokers has that applicants for the best chance of getting rate below 4 percent are those with a steady income that is easy to documents and a credit score of 725 or above and they owe less than they paid for their home. but even those that fit that criteria should expect a lot of scrutiny. >> it is like having an estate to an english professor, and even the dog in your middle name needs to be there. >> they're going over applications with a fine tooth

largest animal rights groups. the initiative would match dogs in overcrowded shelters with people living in city housing. the caretakers would also be given a monthly stipend. but they say the planned experiments colossi as of animals and the homeless, putting both at risk. program organizers cannot understand the group's opposition. >> i think that there is a tremendous amount of compassion and humanity on the part of individuals that are homeless, and i'm really disappointed that the debt cannot tap into that humanity. >> p.e.t.a. has offered to give the city $10,000, matching the grant that was used to start the program. city officials have refused to accept that offer. >> coming up, with some and stay parts on the chopping block on the verge of closing, top party officials were allegedly cashing in. how they are accused of using unused vacation time to pad their paychecks? >> the house was on fire, i was so nervous.

>> >> well people were being shut out of california state parks, some park administrators were cashing in. many collected checks for unused vacation time. the scandal is now under investigation. checkey bedford shows us how it happened. >> the agency that once claimed they did not have enough money to keep 70 state parks open, apparently had more than enough money the year before to pay employees nearly $300,000 in unauthorized vacation buybacks. a man at the helm of the backboard deal, according to publish reports, the high- ranking deputy director. the state parks official at the center of a harassment lawsuit earlier this year for raunchy sex talk. >> employees blew a whistle and said some and was gone on. >> what it's done internally revealed a department wide cover-up to buy back vacation time. in all 55 employees took part, one pay out nearly $30,000,

employees also knew that it should be kept quiet so they were entered as overtime. the audit makes it clear that some employees knew what they were doing was wrong and in an effort not to leave a paper trail they wrote the buy back on post its. according to the audit this was not the first on the parks department made unauthorized payouts to employees. one person told investigators that in the past the department had implemented several buyback plans without consulting, the audit shows on authorized by bats may have happened as many as three times in recent years. but parks officials and the department of justice concluded that while employees violated the policy, no laws were broken. because there were entitled to the payback. >> even if it was illegal, heads should roll. if the word doing something contrary to policy, certain people should be terminated. >> >> a dismal report for state workers on the the retirement

fund. california public employees retirement system reports only a 1% return on its investment portfolio. the return is for the last fiscal year and is far below projections. the poor performance could mean state workers in cities may be asked to contribute more to the fund. >> campaign to oust 12, president obama plans to be back in the bay area when one week from today. this time he is expected to visit alicante, his agenda includes fund-raisers at the fox theater, and a private home in piedmont. he also plans to meet with local technology leaders while he is here. and mitt romney also planning a trip to the bay area. the presumptive presidential nominee is expected to attend a fundraising luncheon at a private home in woodside this sunday. later that day he is a scandal to attend to more fund-raisers in san fransisco. >> investigators trying to figure out what set off a fire that gutted a house in vallejo today. fire crews found a home engulfed

in flames just before 4:00 a.m.. the intense flames and strong wind of threatened to spread to nearby homes so neighbors were evacuated but firefighters were able to contain the flames to just that one home. two people inside got out safely but one of them said that she had to call 9 1 1 more than once. >> the time when so long that i called 9 1 1 three times and they told me to read the address. and i told them to come help. that the house was on fire. i was so nervous. i was so scared. >> no one was hurt all the house appears to be a total loss. >> being called a milestone in the fight against hiv. the action by the fed's today in an effort to prevent infections. >> his is david colby in eighth ♪

house was a mess. so child protective services to me back into the system. >> now he is living with lilly, she grew up helping him. lilly helped push david towards college, but in second grade, he was referred to a specialist because he was failing in school. being diagnosed, and put in special education helped david get the support that he needed. jerry helps him learn not to obsess over the small things, and some basic social skills. >> standing in line, standing up and looking to someone and you talk to them, giving people their space. >> it has devices in here to keep the current flowing. >> sunday davis says that he would like to invent a machine that would generate clean energy. but for now he says >> it is amazing that i am here. and i'm amazed by myself.
